O.P.No.270 of 2022 C.V.KARTHIKEYAN, J., This Petition has been filed seeking Probate of the Last Will and Testament dated 25.04.2016 of G.Srinivasan, who died on 31.03.2021. 2.

The petitioner is one of the beneficiaries and also the sole executor of the Will. The Will had been registered. The respondent are the brother and sister of the testator G.Srinivasan. 3.

The learned counsel had entered appearance on behalf of the first respondent and the first respondent had also filed consent affidavit. The second respondent had been served on 06.07.2022 but had taken a concious decision not to appear before the Court. 4.

The parties were directed to adduce evidence. The petitioner examined himself as PW-1. The Original Will dated 25.05.2016 was marked as Ex.P-1 and the death certificate of G.Srinivasan was marked as Ex.P-2 and the death certificate of Radha Srinivasan was marked as Ex.P-3. The legal heirship certificate of Radha Srinivasan was marked as Ex.P-4.

Thereafter, T.V.Sathyanarayana was examined as PW-2. He was the first attestor of the Will. He identified the Will Ex.P-1 and he also stated that the https://www.mhc.tn.gov.in/judis

C.V.KARTHIKEYAN, J., vsg second attesting witness is R.Swaminathan and he stated that when the Will was executed, G.Srinivasan was in a sound and disposing state of mind. He identified the signatures in the Will and stated that the signatures were signed in the presence of each other. 5.

The consent affidavit of the first respondent is also available in the Court records. The learned counsel also affirmed the same.

In view of the evidence produced, the probate of the Will executed by G.Srinivasan dated 25.04.2016 is granted and this Original Petition is allowed as prayed for.
