Mr. V.Sivalingam Government Advocate for R1to R4 Mr. Durai Murugan, Counsel for R5 To R8 Order This Writ Petition is filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the 2nd respondent to appoint the petitioner on compassionate grounds in pursuance to the representation dated 16.09.2024 without insisting a "No Objection Certificate" from the respondents 5 to 8.
2. The petitioner would submit that he is the son born through the second wife of Late E. Saravanan, who was employed as an Electrical Mestri in the Public Works Department. The petitioner's father died while in service on
08.03.2024. After the death of his father, the 5th respondent, Mrs. Anandhi, the first wife of the deceased employee, received the terminal benefits to the tune of Rs.38 lakhs and family pension, but failed to provide any share or support to the petitioner and his sister. The petitioner would further submit that he is unemployed, dependent on his aged grandmother and facing severe financial hardship. Therefore, he submitted a representation dated 16.09.2024 to the 4th respondent seeking compassionate appointment. The 4th respondent, by proceedings dated 05.02.2025, directed the petitioner to produce a "No Objection Certificate" from the other legal heirs. According to the petitioner, respondents 5 to 8 refused to furnish such consent and denied him any share in the service and pensionary benefits of the deceased employee. Contending that the insistence upon a "No Objection Certificate" has deprived him of consideration for compassionate appointment despite being a legal heir of the deceased employee, the petitioner has approached this Court seeking the aforesaid relief.
3. Heard the learned counsels on the either side and perused the records.
4. Considering the facts and circumstances of the case, this Court, without going into merits of the case, directs the respondents to consider the
petitioner's representation dated 16.09.2024 for compassionate appointment and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
