( Criminal Jurisdiction ) Friday, the Twenty Fifth day of March Two Thousand Twenty Two PRESENT THE HON'BLE MR.JUSTICE R.PONGIAPPAN CRIMINAL MISCELLANEOUS PETITION No.3970 of 2022 IN CRL.RC.NO.1113 of 2021 R.BABU [PETITIONER] Vs P.SIVAKUMAR [RESPONDENT] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the time for depositing 50% if the cheque amount (i.e) Rs.2,50,000/- (Rupees Two Lakh and Fifty Thousand) in S.T.C.No.13/2018 pending on the file of Learned Judicial Magistrate/Fast Track Court, (Magistrate Level) at Tiruvannamalai CRL.RC.NO.1113/2021. (CRL.MP.NO.3970/2022) Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.L.

GAVASKAR, Advocate for the petitioner and of NO APPEARANCE for Sole Respondent the court made the following order:- This miscellaneous petition is filed seeking to extend the time for depositing 50% of the cheque amount (i.e.) Rs.2,50,000/- (Rupees Two lakh and Fifty thousand) in S.T.C.No.13 of 2018 pending on the file of learned Judicial Magistrate/Fast Track Court, (Magistrate Level) at Tiruvannamalai.

2. Heard the learned counsel for the revision petitioner.

3. The learned counsel after tendering apology submitted that the petition in Crl.M.P.No.2458 of 2022 has been filed mistakenly for the relief of modification in respect to the deposit of 50% of cheque amount. Hence, he prays for extension of time to comply with the condition No.5(a) i.e. to deposit 50% of the cheque amount. Further, he gave undertaking to deposit 50% of the cheque amount on or before 12.04.2022.

3. Now on considering the said submission with relevant records, the present criminal revision petition has been filed challenging the order of conviction passed by the learned Judicial Magistrate, Fast Track Court (Magistrate level) at Thiruvannamalai. This Court, on 11.03.2022, directed the trial Court to secure the petitioner/accused, in view of the same, now the petitioner is ready to execute the bond on or before 12.04.2022.

4. Accordingly, time is extended till 12.04.2022 to deposit 50% of the cheque amount i.e. Rs.2,50,000/-. After depositing 50% of the cheque amount, the petitioner is permitted to release on bail.

5. Post the matter on 12.04.2022.
