Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of Mandamus directing the respondents to call the petitioners for interview for Appointment to the Post of Tester Chemical in the existing vacancies without reference to sponsorship from employment exchage and consider them for appointment to the post of Tester Chemical by giving the petitioners preference based on the their employment and service with the respondents in the post of Tester Chemical and not to terminate or dispense with their present services in any manner till the petitioners are considered and given appointment to the post of Tester Chemical

on permanent basis at the time of direct recruitment to the said post in the existing vacancies award costs.

ORDER

The writ petition has filed by the petitioners, to direct the respondents to call the petitioners for interview for Appointment to the Post of Tester Chemical in the existing vacancies without reference to sponsorship from employment exchage and consider them for appointment to the post of Tester Chemical by giving the petitioners preference based on the their employment and service with the respondents in the post of Tester Chemical and not to terminate or dispense with their present services in any manner till the petitioners are considered and given appointment to the post of Tester Chemical on permanent basis at the time of direct recruitment to the said post in the existing vacancies.

2. When the matter is taken up for hearing, learned counsel for the petitoners, on instruction, submitted that during the pendency of the writ petition, the petitioners service were terminated and against the termination of their services, the petitioners have raised industrial dispute.

3. In such view of the matter, nothing further survives for adjudication in the present petition. Accordingly, this writ petition is closed. The petitioners are at liberty to work out their remedies in a manner known to law before the appropriate forum. Consequently connected miscellaneous petition is closed. There shall be no order as to costs.
