The applicants are the plaintiffs 2 and 3 in TOS.

2. The proceedings have been initiated by the plaintiffs 1 to 3 by seeking grant of probate to the suit Will. At that relevant point of time, the 1st plaintiff, who was an executor of Will was alive. Since the 1st plaintiff died subsequently, the plaintiffs 2 and 3 have filed this application to amend the relief from grant of probate to grant of letters of administration. Since the 1st plaintiff died, these plaintiffs have got no other option except to seek letters of administration.

3. Since the prayer is on technical grounds, the application is allowed.
