C.M.P.No.7308 of 2019 in A.S.No.11 of 2017 R.SUBBIAH, J and P.D.AUDIKESAVALU, J (The Order of the Court was made by R.Subbiah, J) Today, when the matter is taken up for consideration, the learned counsel appearing for the impleaded third and fourth respondents/Indian Bank filed a Memo, dated 19.12.2019, relevant portion of which reads as follows: "1. It is submitted that the 3rd and 4th Respondents were impleaded as party respondents in the appeal by this Hon'ble Court pursuant to the petition filed by the Appellant herein. In the affidavit filed in support of impleading petition, it was averred that the 1st respondent issued a letter dated 18.09.2019 to the 3rd and 4th Respondents to disburse the family pension and other benefits of her deceased husband Late Enbasagaram to her Savings Bank A/c.No.6134197401. It was also averred therein that 3rd and 4th Respondents has not credited the pension arrears (PPO No.20057130100362 in her favour till date.

2. It is submitted that as per the pension payment order dated 18.09.2019 issued by the 1st Respondent, the 3rd Respondent dispersed a sum of Rs.17,60,200/- being of arrears of pension for the period from 24.03.2005 to 31.10.2019. That apart, the 3rd Respondent commenced remittance of family pension to the Appellant of Rs.13,250/- from the month of November 2019.

The learned counsel for the petitioner-Gunasundari has also admitted that the amount of arrears of pension was deposited and he has also brought a cheque No.854355, dated 19.12.2019, for Rs.3 lakhs drawn in favour of the second respondent-Nirmala, drawn on Indian Bank, Ayapakkam Branch, Chennai and also admitted payment of Rs.2 lakhs already paid to the said Nirmala and the said cheque is received by the second respondent-Nirmala today. Thus, she has admitted payment of total amount of Rs.5 lakhs.

In view of the payment made by the first respondent-Chief Personnel Officer, Integral Coach Factory, Chennai-600 038, which was duly paid to the second respondent-Nirmala by the petitioner-Gunasundari and that the family pension was also being sanctioned to the petitioner-Gunasundari, as stated in the above Memo, nothing further survives for consideration in this C.M.P., which is accordingly closed, by recording the said Memo.
