Prayer:- Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure to direct the respondents to provide police protection to the petitioner to attend the agricultural operations in R.S.No.289/1 (Old S.No.1366) Patta No.604 of Thalavaipattinam Village, Dharapuram Taluk and also direct the 2nd respondent to take appropriate action against the accused persons in FIR in Cr.No.219 of 2016. O R D E R
This Criminal Original Petition has been filed seeking a direction to the respondents to provide police protection to the petitioner to attend the agricultural operations in R.S.No.289/1 (Old S.No.1366) Patta No.604 of Thalavaipattinam Village, Dharapuram Taluk and also direct the 2nd respondent to take appropriate action against the accused persons in FIR in Cr.No.219 of 2016.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. On a complaint lodged by the petitioner, the https://hcservices.ecourts.gov.in/hcservices/
respondent police registered a case in Crime No.219 of 2016 for offences under Sections 447, 294(b), 506(ii) IPC and under Section 3 of TNPPDL Act against some persons, who deliberately tresspassed into the land of the petitioner and destroyed the crops. Hence, the petitioner approached this Court for a direction to the respondent police to give police protection.
4. Taking into consideration of the nature of the allegation made in the FIR, this Court directs the petitioner to give a representation to the respondent police in person and on such representation being given, the same shall be enquired into and the respondent police is directed to afford sufficient police protection to the petitioner against the trespassers and aggressors.
In the result, the criminal original petition is closed.
