Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the respondents, especially the 2nd respondent made in petition No. 2017/9005/06/756517/0824 dated 23.02.2018, quash the same as null and void, illegal and invalid and consequently direct the 2nd respondent to appoint the petitioner as per the actual selection list with all service benefits.

ORDER

With the consent of both the parties, this writ petition is taken up for final disposal.

2. The petitioner herein is an unsuccessful candidate in the selection process conducted by the second respondent herein for the post of Anganwadi Worker. The petitioner questions the appointment of the fifth respondent in the said selection process.

3. Today, when the matter was called, the learned Special Government Pleader appearing for the respondents 1 to 4 submitted that though the petitioner was an eligible candidate for consideration, owing to the higher marks secured by the fifth respondent, she was found ineligible. However, the learned Special Government Pleader, on instructions, submitted that as on date, there are 22 vacancies in the Main Centers and 2 vacancies in the Mini Centers of the Child Development Project Office at Tiruvannamalai Rural and that they are willing to accommodate the petitioner in one of these vacancies.

4. The learned counsel for the petitioner also does not have objections to the same and would submit that he is not pressing the writ petition, questioning the appointment of the fifth respondent herein.

5. Recording the submission of the learned Special Government Pleader, there shall be a direction to the third respondent herein to pass appropriate orders, appointing the petitioner herein as an Anganwadi Worker in any one of the vacancies of their office in Tiruvannamalai Rural, atleast within a period of eight (8) weeks from the date of receipt of a copy of this order.
