Respondent(s) PRAYER Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to disburse the 62 percent of compensation award amount with acquired interest for acquisitioning the land in S.No.122/3B and 125/ 1A1A to an extent of 1 Acre and 10 cents in Meenambakkam village, Chengalpattu to the petitioners herein by Considering the representation dated 30.10.2024 and 20.05.2024 within a period of time frame to be fixed by this court. ORDER
This writ petition has been filed for issue of writ of mandamus directing the respondents to disburse 62% of the compensation award amount along with interest based on the representation made by the petitioners on 30.10.2024 and 20.05.2024.
3/6 2.When the writ petition came up for hearing on 03.04.2025, this Court directed the learned Additional Government Pleader appearing on behalf of the respondents to take instructions and directed the matter to be listed for hearing today.
3.When the matter was taken up for hearing today, the learned Additional Government Pleader produced the written instructions received from the Special Tahsildar. It is also seen that a communication dated 06.09.2024 has been addressed by the Special District Revenue Officer to the Revenue Divisional Officer, Tambaram and a copy has been marked to the Sub Court, Tambaram. On going through the same, it is clear that some of the land owners numbering 39 sought for a reference and instead of depositing the compensation payable to them in the Court, the entire compensation amount covering all the land owners were deposited before the Sub Court, Tambaram. In view of the same, the compensation deposited for those land owners who had not approached the Court, was sought to be withdrawn from the Court in order to pay the compensation to the respective land owners. Since there was no progress
4/6 thereafter, a remainder has been sent to the Special Tahsildar by the Special District Revenue Officer.
4.Taking into consideration the facts and circumstances of the case and considering the stand taken by the respondents, there shall be a direction to the st respondent to deal with the representation made by the petitioners on 30.10.2024 and disburse the balance compensation award amount with accrued interest, if any, within a period of six weeks from the date of receipt of copy of this order.
