..Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider petitioner's representation dated 26.01.2026 and to pass orders by allotting light employment, within a time frame to be fixed by this Court.

ORDER

The above writ petition has been filed seeking a mandamus to the respondents to consider the petitioner's representation dated 26.01.2026 and to pass orders by allotting light employment, within a time frame fixed by this Court.

2. The petitioner had joined the service of State Transport Corporation as Driver on 09.04.2009. During his course of employment, he was diagnosed with coronary artery disease and had undergone surgery on 17.11.2025. He was advised by doctors not to involve in jobs like driving heavy vehicles. In this regard, the petitioner had submitted a representation to the respondents on 26.01.2026, to provide light jobs in the respondent-Corporation so as to enable him to continue his service, peacefully. Since the representation was not considered to date, the petitioner is before this Court.

3. Heard the learned counsel on either side and also perused the materials placed before this Court.

4. Considering the medical condition of the petitioner, the writ petition is disposed of with the following directions :

(a) The second respondent shall forward the copy of the petitioner's application / representation to the Medical Board along with his medical records, for assessing disability / discomfort of the petitioner and to ascertain as to whether the petitioner is in a position to continue and discharge his duty as a Driver, within a period of one week from the date of receipt of a copy of this order.

(b) The Medical Board shall submit their report at the earliest preferably within a week from the date of assessment to the second respondent providing his suggestion on the above.

(c) Upon receipt of the report from the Medical Board, the respondents shall consider the case of the petitioner and pass orders, within a period of three weeks therefrom.

No costs.
