O R D E R

This Criminal Original Petition is filed to quash the complaint in Cr.No.15 of 2023 on the file of the first respondent police on the ground that the matrimonial dispute which has been given a criminal colour with malafide intention. There is no material to infer offences to punish under Sections 498A, 506(i) IPC and Section 4 of Tamilnadu Prohibition of Women Harassment Act. Therefore, complaint must be quashed.

2. The learned Government Advocate(Crl.Side) appearing for the respondent police on instructions from the Investigating Officer submits that the on completion of the investigation final report filed on 10.06.2024 vide LTN20230000957C202400022. He further submits that the materials collected in the course of investigation had provided sufficient material to frame charge against the petitioners and proceed for the offences under Sections 498A, 506(i) IPC and Section 4 of Tamilnadu Prohibition of Women Harassment Act.

3.Since apart from FIR which is now relied by the petitioner 2/4

herein, the statements of the witnesses and the conclusion of the Investigating Officer have come to light by way of final report. Hence, the petition to quash the FIR stands dismissed with liberty to the petitioner herein to take legal recourse in the manner known to law after receipt of the copy of documents relied by the prosecution and the final report.
