Prayer: Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the respondent to issue a new passport to the petitioner as requested in his application bearing file No.MA1071016457113 on the file of the respondent.

O R D E R

The petitioner seek for a mandamus directing the respondent to issue new passport to the petitioner, based on his application bearing File No. MA1071016457113 acknowledged by the respondent as early as on 27.05.2013.

2. Heard Mr.G.Masilamani, learned senior counsel appearing for the petitioner and Mr.Murugan, learned Senior Panel counsel appearing for the respondent.

3. The grievance of the petitioner before this Court is that even though the said application was filed as early as on 27.05.2013, the respondent is not passing any order so far. https://hcservices.ecourts.gov.in/hcservices/

4. Needless to say that when an application is filed seeking for passport, the concerned authority cannot keep the application pending for a long time without passing any order and communicating the same to the applicant. At the same time, this Court is not expressing any view with regard to the entitlement of the petitioner to get such passport as it is for the respondent to consider and decide on merits and in accordance with law. Thus, this writ petition is disposed of by granting the respondent to consider the application of the petitioner on merits and in accordance with law and pass orders within a period of three weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petitions are closed.
