Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition that the petitioner shall stay at Trichy daily at 5.30 p.m., until further orders in Crl.MP.No.9912/2019 in Crl.A.No.383/2019 dated 27.11.2019.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. E.C.RAMESH, Advocate for the Petitioner and of M/S. K.PRABAKAR, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- (Order of the Court was made by P.N.PRAKASH,J) This criminal miscellaneous petition has been filed seeking to relax the condition that the petitioner shall stay at Trichy and report before the Town Police Station, Trichy, daily at 5.30 p.m. until further order in Crl.M.P.No.9912 of 2019 in Crl.A.No.383 of 2019 dated 27.11.2019.

The suspension of sentence and bail was granted by this Court to the petitioner on 27.11.2019 in Crl.M.P.No.9912 of 2019 in Crl.A.No.383 of 2019 on various conditions, one of which is that, the petitioner was directed to appear before the Inspector of Police, Town Police Station, Trichy, daily at 5.30 p.m., for relaxing which, the petitioner has preferred the present criminal miscellaneous petition.

On instructions, learned Additional Public Prosecutor submitted that the petitioner has complied with the said condition till 30.03.2020 and thereafter, on account of COVID-19 lock down, the petitioner was not able to comply with the same. In such view of the matter, the aforesaid condition is relaxed to the effect that the petitioner shall report before the trial Court, on the first working day of every month at 10.30 a.m. until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.
