The challenge in this writ petition is to the order dated 27.06.2013 passed by the second respondent, by which the punishment of Censure was imposed on the petitioner, while he was working as Joint Director of Public Health and Preventive Medicine.

2. Heard the learned counsel for the parties and perused the materials on record.

An enquiry was initiated against the petitioner on the allegation that he had failed to conduct the enquiry and submit the enquiry report within the stipulated time in respect of the disciplinary proceedings against one N. Bharathi. It was further alleged that he failed to hand over the relevant records required for the conduct of the enquiry and neither conducted the enquiry nor handed over the connected back files, records, and enquiry report.

4. The explanation submitted by the petitioner was found to be unsatisfactory. Consequently, the second respondent concluded that the Page Nos.2/4

petitioner, being the delinquent officer, failed to conduct the enquiry within the stipulated time and also failed to hand over the relevant documents pertaining to the enquiry. There is no material on record to substantiate the claim of the petitioner that the documents were handed over.

5. In the absence of any perversity or illegality in the decisionmaking process, this Court finds no reason to interfere with the impugned order. Accordingly, the Captioned Writ Petition stands dismissed. There shall be no order as to costs.
