ORDER

WMP. No.8279 of 2026 is ordered subject to the payment of separate court fee.

2.The grievance of the petitioners is that despite the second respondent having initiated prosecution under Section 83 of the Registration Act to prosecute respondents 4 and 5 as early in the year 2017 itself, till date, no further proceedings has been initiated by the second respondent with regard to the said prosecution.

3.Mr.P.Harish, learned Government Advocate accepts notice on behalf of respondents 1 to 3. Since no adverse order is being against respondents 4 and 5, notice to respondents 4 and 5 is dispensed with.

4.Since this writ petition is filed with an inordinate delay, the question of entertaining this writ petition at this belated stage, i.e. after a lapse of more than 8 years from the date when the second respondent decided to prosecute the offenders under Section 83 of the Registration Act, does not arise. The representation which is reflected in the prayer of this writ petition, said to have been given by the petitioners, is also dated 31.12.2014. The only relief that can be granted by this Court in this writ petition is to grant liberty to the petitioners to set the criminal law in motion by lodging a criminal complaint before the concerned police against the offenders, who have committed violations under Section 82 of the Registration Act.

5.Accordingly, this writ petition is disposed of by granting liberty to the petitioners to set the criminal law in motion by lodging a criminal complaint before the appropriate police against the offenders i.e. respondents 4 and 5 for the alleged violations said to have been committed under Section 82 of the Registration Act. No costs.
