Prayer:- Criminal Appeal filed under Section 374 of the Code of Criminal Procedure against the order and judgment passed on 04.04.2010 in SC.No.261 of 2008 by the Hon'ble Judge, Magalir Needhimantram, Chennai sentencing the appellant to imprisonment for 10 years rigorous imprisonment under Section 376 (2)(g) I.P.C. together with sentence of fine of Rs. 30,000/- in default to undergo simple imprisonment for one year under Section 376

(2) (g) I.P.C and one year RI under Section 341 I.P.C. and one year R.I. Under Section 506(2) r/w 34 I.P.C, all sentences to run concurrently.

The learned counsel appearing for the appellant submitted that the appellant in C.A.No. 543 of 2011, had served the entire sentence and he has been released pending appeal and the learned counsel for the appellant seeks permission to withdraw the criminal appeal.
