BHARATHA CHAKRAVARTHY CRIMINAL MISCELLANEOUS PETITION No.6292 of 2022 IN CRL RC.595/2022 ASAITHAMBI [ PETITIONER ] Vs NAGARAJAN [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Suspend the Sentence imposed by Judgment dated 25.10.2021 passed in Crl.A.08/2021 on the file of the Additional District and Sessions Judge, Dharmapuri and Conformed Judgment made in C.C.55/2017 on the file of the Judicial Magistrate (FTC), Dharmapuri dated 16.03.2020 and enlarge the petitioner on bail till the disposal of the above CRL RC.595/2022.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S M.JAYACHANDRAN, Advocate for the petitioner the court made the following order:- Inspite of the directions by this Court, by its order, dated 06.06.2022 in Crl.M.P.No.6293 of 2022 in Crl.R.C.No.595 of 2022, the petitioner has not surrendered before the Trial Court.

2. In that view of the matter, this petition to suspend the sentence is dismissed.

3. Since, this petition for suspension of sentence is dismissed, the respondent is entitled to approach the Trial Court and the Trial Court is directed to issue/execute a warrant to commit the petitioner into prison to undergo the sentence.
