ORDER
This Writ Petition has been filed for the issuance of a Writ of Mandamus directing the respondents to consider the petitioner's candidature for the post of Sanitary Worker / Sweeper in the available vacancies based on his representation dated 20.01.2020 made to the respondents.
2. The petitioner applied to the post of Sanitary Worker / Sweeper in pursuant to the advertisement in Daily Thanthi News paper dated 06.11.2019. She also attended the interview on 13.01.2020 before the fourth respondent. However, the petitioner came to know that the respondents are choosing the candidates as per their whims by neglecting the in-service Sanitary Workers like the petitioner. The very same petitioner had already filed a writ petition in W.P.No.3390 of 2020 seeking more or less similar
relief and in which a direction has been given to the fourth respondent to complete the process of recruitment within a period of four weeks from the date of receipt of a copy of that order. However the petitioner once again filed this writ petition by seeking direction to the respondents to consider his candidature to the post of Sanitary Worker and as requested by him in his representation dated 20.01.2020.
3. The learned Government Advocate submitted that the petitioner's representation has a specific mention that he should be considered against the vacancies meant for MBC / BC community.
4. The respondents can accommodate the petitioner only if any particular vacancy is reserved as against a particular category and if the petitioner is found to be eligible to be fit into the same. Since the earlier direction given in the earlier writ petition itself is sufficient and the respondents has not considered and passed any order, I feel the respondents should be once again be directed to comply the order of this Court made in the earlier writ petition.
5. Accordingly, this Writ Petition is disposed with a direction to the respondents to comply the order of this Court in W.P.No.3390 of 2020 dated 13.02.2020 in true letter and spirit. While passing order in pursuant to the above direction, the respondent shall also consider the present representation given by the petitioner on 20.01.2020 and pass orders in accordance with the rules applicable to the case of the petitioner within a period of six weeks from the date of receipt of a copy of this order. No costs. Connected miscellaneous petition is closed.
