Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, directing to call for the records relating to the proceedings of 2nd respondent dated 29.05.2014 & 30.05.2014 issued in No.21359/64/2013 & Na 5273/SJI/2014 and quash the same and consequently to direct the respondents 1 & 2 to permit the petitioner to retire from service with effect from 31.05.2014 onwards without prejudice to the outcome of the criminal case registered against the petitioner in FIR No.113 by the Ernakulum Railway Police, Kerala State and to pay all the consequential benefits including regular pension and its arrears with 18% 1/4

interest from the date of actual superannuation till the date of actual realization.

ORDER

This writ petition has been filed challenging the order of suspension and not permitting the petitioner to retire from service upon attaining the age of superannuation. Subsequent to the said orders, an order imposing the punishment of dismissal was passed against the petitioner and the said order of dismissal was challenged in W.P.No.33132 of 2015. In view of the same, the relief sought in this writ petition has practically has become infructuous. 2.In view of the same, the writ petition is dismissed as having become infructuous. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed. 18.12.2024 vsn 2/4
