PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the respondents to provide adequate Police protection to the employees as well as the machinery of the petitioner society for laying the pipeline on the corner beneath the road viz
from the petitioner's well located at Molasi Village, comprised in Survey No.281/2B2 to the Overhead Tank constructed in the land belonging to the petitioner at Pudupuliyampatti Village, comprised in Survey No.2/1A2, in compliance with the G.O.(4pa) No.45, Public Works (N1) Department dated 25.02.2021 by considering the representation of the petitioner dated 16.02.2023 and to pass such further or other orders as this court may deem fit and proper in the facts and circumstances of the case. O R D E R
The Writ Petition has been filed to direct the respondents to provide adequate Police protection to the employees as well as the machinery of the petitioner society for laying the pipeline on the corner beneath the road viz from the petitioner's well located at Molasi Village, comprised in Survey No.281/2B2 to the Overhead Tank constructed in the land belonging to the petitioner at Pudupuliyampatti Village, comprised in Survey No.2/1A2, in compliance with the G.O.(4pa) No.45, Public Works (N1) Department dated 25.02.2021 by considering the representation of the petitioner dated 16.02.2023.
2.The learned counsel for the petitioner submitted that petitioner/Sangam was formed with the object of providing irrigation facilities to the agricultural lands of its members in an extent of 375 acres for the purpose of cultivation by taking water through pipeline on the corner beneath the road. The Government of Tamil Nadu by its Public Works Department issued a Government order in G.O.(4pa) No.45 dated 25.02.2021 permitting the said water scheme. 50% of the pipeline work is completed. At this point, some of the local people started preventing the employees from doing the work with ulterior motive and threatened them with dire consequence. They also made threat to damage the imported pipes. Because of the intervention of the public, the pipeline work could not be proceeded.
Petitioner/Society sent a representation to the respondent dated 16.02.2023 seeking intervention. Till now, no action was taken on the representation, necessitating filing of this petition. 3.
16.02.2023 is available with the respondents and appropriate orders would be passed.
4.Considered rival submissions and perused the records. 5.It is seen from the G.O.(4pa)No.45, Public Works (N1) Department that Government orders irrigation facility through pipelines to the members of petitioner's Society. It is reiterated by the Public Works Department through its letter dated 31.03.2021. Petitioner's Society paid a sum of Rs.6,00,000/- to the Government for the purpose of laying pipelines. Photographs also filed to show the progress of pipeline work. In the said circumstances, this Court finds that the pipeline work is being carried out after approval from necessary Government Departments. Therefore, this Court directs the respondents to consider petitioner's representation dated 16.02.2023 and pass appropriate orders including providing adequate Police protection within a period of two weeks from the date of receipt of copy of this order.
6. With the above direction, this Writ Petition is disposed of. No
costs.
