This petition has been filed to condone the delay of 690 days in preferring the appeal.

2. The reasons assigned in the affidavit filed along with the petition is that originally the appeal has been filed in time. However, the same has been returned for some correction. In the meanwhile, the learned counsel Mr.G.R.S.Chander Rao died in the year 2019. Therefore, the present learned counsel has been appointed in the 2020 and due to pandemic outbreak and lock down, he could not communicate and approach the Court. Therefore, there is a delay of 690 days in preferring the appeal.

3. The respondent filed the counter stating that delay has not been properly explained. Therefore, he opposed the the petition.

4. The facts that the appeal has been filed in time and thereafter, it has been returned for correction and in the meanwhile, the learned counsel who was engaged had died have not been disputed in the counter. That https://www.mhc.tn.gov.in/judis

vrc apart, it is also an admitted fact that the pandemic was struck in the nation and lock down was imposed. Considering all these facts and in order to given a fair opportunity to the parties to agitate their rights on merits, this Court is inclined to extend liberal approach to condone the delay.
