Heard Mr. T.R.Udaya Kumar, Learned Counsel for the Petitioner and Mr. P.Balathandayutham, Learned Special Government Pleader appearing for the Respondents and perused the materials placed on record, apart from the pleadings of the parties.

The Petitioner, who was working as Assistant of 6(TN) Battalion NCC, Annamalai Nagar, on completion of seven years of continuous service was transferred to NCC Group Headquarters, Tiruchirappalli by Order in Memo No. 16 of 2016 dated 31.05.2016 passed by the Second Respondent, which is challenged in this Writ Petition.

It is borne out from the materials placed on record that though the Petitioner has sought for interim stay of the operation of the impugned order during the pendency of the Writ Petition in W.M.P. No. 18326 of 2016, no orders have been passed in that regard.

Having due regard to the fact that it is accepted by both sides that the Petitioner was due to retire from service on 30.06.2018 on attaining the age of superannuation, nothing remains for further consideration in the matter. In such circumstances, there does not appear to be any useful purpose served by venturing into the task of testing the validity of the impugned order at this distance of time.

In the result, the Writ Petition is disposed. Consequently, the connected Miscellaneous Petition is closed. No costs.
