Even though the petition has been filed by Mr.R.Muthaian, learned Counsel for the petitioner, when the matter is called today, Mr.K.J.Sivakumar represents the matter as the learned Counsel for the petitioner.

2.It is seen that the 2nd respondent has been served and name has been printed but none represented on behalf of the 2nd respondent. However, this Court is convinced with the reasons stated in the affidavit filed in support of this petition to condone the delay of 120 days in filing the appeal and hence, this petition is ordered.
