The suit was transferred from the City Civil Court, Chennai to the file of this Court, on application filed by the defendant. 2.The other suit which is now pending and which has to be examined along with the present suit in C.S.No.356 of 2021 in which pleading have completed.

3.So far as this application is concerned namely A.No.1329 of 2023, it had been filed seeking to reject the plaint. Since pleadings are complete and there is also an another suit between the same parties on the same cause of action and with respect to the same issues, it would only be appropriate that the parties are given opportunity to tender evidence and the plaintiff is not ousted at the door step itself.
