Writ Petition has been filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents to deposit the award amount in the Motor Accidents Claim Tribunal, Thiruvannamalai (Additional Sub-Court, Thiruvannamalai), in M.C.O.P.No.13 of 2011 dated 29.02.2012, along with enhanced amount passed in C.M.A.No.1023 of 2015 dated 31.08.2015, with the accrued interest, cost and expenses, in the petitioner Account in A/c.No.053601000060819, Indian Overseas Branch, Tiruvannamalai Town Branch, Tiruvannamalai-0536, within a stipulated time, through ECS Payment.

ORDER

This writ petition has been filed by the petitioner, praying for issuance of a Writ of Mandamus, directing the respondents to deposit the award amount passed in M.C.O.P.No.13 of 2011 dated 29.02.2012 by the Motor Accidents Claim Tribunal, Thiruvannamalai (Additional Sub-Court, Thiruvannamalai), along with enhanced amount passed in C.M.A.No.1023 of 2015 dated 31.08.2015, with the accrued interest, cost and expenses, in the petitioner's bank Account in A/c.No.053601000060819, Indian Overseas Branch, Tiruvannamalai Town Branch, Tiruvannamalai0536, within a time frame, through ECS Payment. https://hcservices.ecourts.gov.in/hcservices/

2.When the matter is taken up for consideration, the learned counsel for the respondents-Insurance Company submitted that they would deposit the amount as prayed for in the present writ petition, as per the judgment delivered by the Division Bench of this Court in C.M.A.No.428 of 2016, dated 11.03.2016 (The division Manager, Oriental Insruance Company Ltd., Kannur Vs. Rajesh and others), within a period of one month. The said submission made by the learned counsel for the respondents is recorded.

3.In view of the above submission made by the learned counsel for the respondents, this writ petition is dispose of, with a direction to the respondents to deposit the amount as claimed by the petitioner in the present writ petition, within a period of one month from the date of receipt of a copy of this order. No costs.
