ORDER
The above Civil Revision Petition is filed challenging the return being made by the Chief Judicial Magistrate (Motor Accident Tribunal), Tiruppur, without numbering the petition filed by the revision petitioner under Section 163 and 165 of C.R.P. for the payment of the award amount to him.
2.The learned Judge appears to have returned the petition on two occasions on the ground that the Transport Corporation has filed a Civil Miscellaneous Appeal before this Court. However no stay has been obtained by the Transport Corporation before this Court. In the absence of the stay, the tribunal is bound to number the petition and post the same for orders. 3.The learned Chief Judicial Magistrate (Motor Accident Tribunal), Tiruppur, is directed to number the petition within a period of 15 days from the date of receipt of a copy of the order.
4.The original papers are returned back to the revision petitioner. The counsel for the revision petitioner has also made an endorsement, endorsing the receipt of the original papers. The Civil Revision Petition is disposed of on the above lines. There shall be no order as to costs.
