ORDER
The writ petition has been filed seeking a mandamus to the respondents to revise the petitioner's wages with effect from 01.09.2023 based on the 15th wage settlement dated 29.05.2025 and pay him the difference in Leave Salary, Gratuity and Arrears of Pension from 01.04.2024 to 31.07.2025 along with the interest at the rate of 12% per annum from the date of entitlement to till the date of actual disbursement within a time limit to be stipulated by this Court.

The petitioner joined the services of the first respondent/Corporation as Conductor on 21.04.1995 and retired from service on attaining the age of superannuation on 31.03.2024. It is the case of the petitioner that he is entitled to full benefits arising out of the 15th wage settlement and therefore, the respondents have to pay the difference in gratuity and leave salary based on the revised wages. Further, due to an
inordinate delay in settling the retirement benefits, viz., gratuity, leave salary and pension and pre-revised wages, he is entitled to claim interest for such delay. Therefore, he submitted a representation dated 06.01.2026 to the respondents seeking the aforesaid payments and since the same has not been considered, he has filed the present writ petition. 3.
The learned counsel for the petitioner submitted that the terminal benefits payable to the petitioner were disbursed belatedly and further, the differential amounts payable under the 15th wage settlement has not been paid so far. Hence, it would suffice, if a direction is issued to the respondents to consider the petitioner's representation dated 06.01.2026 and pass appropriate orders on merits within a time frame. 4.
The learned Standing Counsel appearing for the respondents acceded to the aforesaid submissions made by the learned counsel for the petitioner and submitted that the respondents are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amounts.

Considering the aforesaid submissions, this Court directs the respondents to consider the petitioner's representation dated 06.01.2026 with regard to the payment of differential amount as per the 15th wage settlement and pass appropriate orders on merits and in accordance with law. Further, in view of the above submission made by the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of the admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the case.
With the above directions, this writ petition stands disposed of. No costs.
