CMP Nos.677, 678 and 679 of 2018 in Second Appeal No.859 of 2016 N.ANAND VENKATESH, J ., These Civil Miscellaneous Petitions have been filed to implead the legal representatives of the deceased 1st respondent along with petitions to set aside abatement and to condone the delay in filing the set aside abatement petition.

2. Heard the learned counsel appearing on either side.

3. Considering the reasons stated in the accompanying affidavits filed in support of these petitions, these Civil Miscellaneous Petitions are ordered.

4. Registry is directed to carry out the necessary amendments in the cause-title.

5. The learned counsel who was appearing for the sole respondent shall take instructions as to whether they will appear for the impleaded respondents 2 to 8 and if so, they shall file the vakalat on behalf of the impleaded respondents 2 to 8, before the next date of hearing. In the meantime, the learned counsel for the appellant is directed to take notice to the impleaded respondents 2 to 8 both through Court and privately returnable by 22.04.2022. The batta shall be filed on or before 06.04.2022.
