However, the instant petition is filed for accepting cause title on account of the fact that the first defendant Palani Kounder had passed away. After pronouncement of the judgment and decree in A.S.No.16 of 2012 on 08.10.2014, the first defendant passed away on 07.12.2017. The appeal has been filed on 08.02.2021. One of the legal representatives is already on record as the fourth respondent and only the fifth respondent has to be added as the other legal heir of the deceased Palani Kounder in the above Second Appeal.
