This petition has been filed to modify the condition imposed on the petitioner is directed to deposit a sum of Rs.5,00,000/- into the credit of Crime No. 255 of 2022 before the concerned Magistrate within a period of three weeks from the date on which the order copy made ready in the above Crl.O.P.No.2738 of 2023 dated 08.02.2023.

2. The learned counsel for the petitioner submitted that coaccused A3 and A4, who are relatives of petitioner herein were arrested and they were granted bail on condition to deposit a sum of Rs.3 lakhs each to the credit of crime number. Thus, it is caused huge financial deprival to the petitioner's family and they are put into huge monetary loss. Hence, the present petition has been filed to modify the condition.

3. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to 1/3

be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit a sum of Rs.3,00,000/- (Rupees three lakhs only) into the credit of Crime No.255 of 2022 before the concerned Magistrate within a period of two weeks from the date of receipt of copy of this order.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 2738 of 2023 vide order dated 08.02.2023 shall remain unalterted.

5. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 17.03.2023 rpp 2/3
