O R D E R

The petitioner seeks bail in respect of Crime No.294 of 2019 registered against him under Sections 420, 467, 468, 120 B of the Indian Penal Code

and Sections 66C and 66D of the Information Technology (Amendment Act 2008) .

2. The charges relate to online fraud, though the petitioner claims that he was only carrying out the instructions of the superiors and he has no role to play in execution of those details. A perusal of the order of the learned Principal Sessions Judge, Chennai shows that the petitioner has made calls to several persons and induced them to deposit certain percentage of amount in his account for sanctioning the loan and subsequently by using the customer card and the particulars obtained from the victim, he has withdrawn cash from various accounts. It is also seen that the amount involved the entire fraud exceeds a crore of rupees.

3. The learned Additional Public Prosecutor would also submit that complaints are still pouring in and this fraud has got a Pan India impact. He would also submit that it is likely that the amount involved in the fraud may cross 10 crores of rupees.

4. Considering the nature of the offence and the fact that the investigations are pending, I do not think that the petitioner could be enlarged on bail at this stage. Hence, this petition is dismissed. 15.04.2020 jv To
