Respondents Prayer: Petition is filed under Article 226 of the Constitution of India praying to issue a writ of mandamus, to direct the first respondent to pay the award amount of Rs.25,000/- passed by the learned II Small Causes Judge, dated 21.10.1997, along with interest at the rate of 12% per annum from 22.12.1997 to 8.4.2015 amoiunting to Rs.51,878 towards damages for causing mental agony at the rate of Rs.1,00,000/- and for the cost of this petition.

The learned counsel appearing for the petitioner is seeking to withdraw the writ petition in view of the communication sent by the 1st respondent to the 2nd respondent dated 8.10.2015, wherein it has been stated as below:
"The above OP was settled in Lok Adalath and we had deposited the compromised amount of Rs.25,000/- on 12.03.1998. But while depositing we had wrongly mentioned the OP number as 849/97 instead of 899/97. We confirm that the amount deposited is in respect of OP 899/97 only. We are sorry for the inconvenience caused in this regard and we request you to carry out necessary correction."

Accordingly, the writ petition is dismissed as withdrawn. No costs.
