PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or any other appropriate writ or order or direction, in the nature of writ, directing the 1st respondent to consider the petitioner's representation dated 02.01.2023 for issuance of computerized patta and computerized chitta in favour of the petitioner in respect of lands measuring an extent of 1.93 acres comprised in old survey No.573/2B present T.S.No 4, Ward-A, Block-31 of Hosur Town and Taluk, Krishnagiri District within the time to be stipulated by this Court.

ORDER

With the consent of both sides counsel, the writ petition is disposed of as under at the admission stage itself.

2. Heard the learned counsel for the petitioner and Mr.R.P.Murugan Raja, learned Government Advocate appearing for the respondents.

According to the learned counsel for the petitioner, the land measuring to an extent of 1.93 acres comprised in old survey No.573/2B present T.S.No 4, Ward-A, Block-31 of Hosur Town and Taluk, Krishnagiri District belonged to the petitioner and the same was acquired by the Housing Board for implementing the neighbourhood Housing Scheme. Thereafter, the land acquisition proceeding was quashed and the revenue records were mutated in the name of the petitioner manually, but, in the computerized records the same has not been updated. the petitioner herein had given a representation to the respondents on 02.01.2023, to issue computerized patta and computerized chitta in her favour in respect of lands mentioned above. Since the said representation was not considered by the respondents, the present Writ Petition has been filed.

4. The learned Government Advocate appearing for respondents would submit that eight(8) weeks time limit may be given to the respondents to consider the representation of the petitioner dated 02.01.2023 and call for enquiry and pass necessary orders.

Taking into consideration the nature of relief sought for in this writ petition and also looking into the averments made in this writ petition, this court is of the considered opinion that a duty is cast upon the Statutory Authority viz., respondents to consider the representation dated 02.01.2023 on its own merits and pass appropriate orders.

6. In such view of the matter, without going into the merits of the claim of the petitioner, there shall be a direction to the respondents 3/5

herein to consider the petitioner's representation dated 02.01.2023 and pass appropriate orders within a period of eight(8) weeks from the date of receipt of a copy of this order.

7. With the above direction, the Writ Petition stands disposed of. No costs.
