When it is pointed out that the Petitioner has an effective alternative remedy to raise an industrial dispute under Section 2-A of the Industrial Disputes Act, 1947, before the jurisdictional Labour Court, Learned Counsel for the Petitioner seeks permission of the Court to withdraw this Writ Petition with liberty to resort to the said procedure and he has also made an endorsement to that effect in the court record. It is made clear that the purpose of reckoning limitation for availing the aforesaid remedy, the period from the date of filing of the Writ Petition viz., 03.03.2023, till the date on which the certified copy of this order is made ready by the Registry, shall be excluded. 2.
In fine, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
