JUDGMENT
(Judgment of this Court is made by Mr.K.Kumaresh Babu.,J.) This Intra-Court Appeal has been preferred as against the order of the learned Single Judge passed in a Batch of Writ Petitions.
2. Heard Mr.A.Vijayakumar, learned counsel for Mr.M.Devaraj, learned counsel for the appellant and Mr.K.V.Sajeev Kumar, learned Special Government Pleader for the respondents.
3. When this Appeal had come up for hearing on 24.11.2023, it was brought to the notice of this Court that as against one of the Writ Petition namely W.P.No.8061 of 2013 which was dealt with in the common order, had been reversed by the Division Bench of this Court in W.A.No.2771 of 2019 and as against the same, a Special Leave Petition had been preferred by the State in S.L.P.(Civil).No.15062 of 2021. Hence, this Court had adjourned the same awaiting the orders of the Hon'ble Apex Court. 4.It is now brought to our notice that the Hon'ble Apex Court by its order dated 23.01.2024 had dismissed the Special Leave Petition holding 2/5
that they are not inclined to interfere with the judgment of the Division Bench.
5. In view of the above, that the order of the learned Single Judge had already been dealt with by the Division Bench of this Court in W.A.No.2771 of 2019 and affirmed by the Hon'ble Apex Court, we are of the view that the order impugned before us would also have to be interfered with.
6. In fine, this Writ Appeal is allowed on the same terms of the order made in W.A.No.2771 of 2019 and the order of the learned Single Judge is set aside. However, there shall be no order as to costs. (R.S.K.,J.) (K.B., J.) 02.02.2024 Index: Yes/No Speaking Order/Non Speaking Order gba 3/5
