O R D E R

It is the case of the petitioner that on the complaint lodged by the defacto complainant, the respondent police have registered a case in Crime No.501 of 2012 for the offence under Section 379 IPC and Section 145(3), 4 of the Tamil Nadu Electricity Act, in which, the petitioner filed a bail petition before the Court below and he enlarged on bail by the Court below on 19.07.2018 with a condition that he should appear before the Court below daily at 10.30 a.m. and sign until further orders. It is further submitted that the petitioner is complying with the condition imposed on him for the past 14 days and subsequently, he filed a petition under Section 439(1)(b) Cr.P.C. seeking for modification before the trial Court. On 06.08.2018, the trial Court dismissed the said petition, against which, the petitioner is before this Court for relaxing the condition.

2.Mr.C.Raghavan, learned Government Advocate would submit that the petitioner/accused has complied the condition only for a period of 14 days.

3.Considering the facts and circumstances of the case and also the submission of the learned counsel on either side, this Court is of the view that the condition imposed on the petitioner in Crl.M.P.No.1270 of 2018 in C.C.No.3 of 2016, is https://hcservices.ecourts.gov.in/hcservices/

hereby relaxed i.e., the petitioner/accused shall appear before the trial Court twice in a week and sign before them until further orders.
