The delay in filing this application has already been condoned by this Court. This application has been filed seeking to restore the suit which was dismissed for default on 27.06.2022. Even though the learned counsel for the respondents / defendants has raised objection for allowing this application, this Court after giving due consideration to the contents of the affidavit filed in support of this application is of the considered view that sufficient cause has been shown for allowing this application. Hence, this application is allowed as prayed for and the suit in C.S. No.358 of 2019 is restored to file. Post the matter for filing of written statement by the defendant on 11.12.2023.
