This Petition has been filed to condone the delay of 276 days in filing the above Civil Miscellaneous Appeal.
2. First respondent and the second respondent were set exparte vide(Batta & C.M.P.SR.No.11067). Though notice is served on respondents 3 to 5, none appears.
3. I have gone through the affidavit filed in support of the petition and I am of the view that the delay of 276 day may be condoned on condition that the petitioner forfeits the interest for the delay period of 276 days.
4. Therefore, the delay of 276 days is condoned and the petition is accordingly ordered, on condition that the petitioner shall forfeit the interest for the delay period of 276 days.
5.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same 'for admission'. 6.Accordingly, this CMP is ordered.
