A.No.2256 of 2019 in T.O.S.No.28 of 2007 R.SUBRAMANIAN.J., This application has been filed seeking to implead the respondents 2 to 11/legal representatives of Mr.K.Albert Amirtharaj and K.Edward Ebenezer who are brothers of the testatrix Ms.Beatrice Beulah.

2. Mr.K.S.Sri Giriprasad, learned counsel appears for the respondents 1 to 7 (proposed parties 2 to 7). The proposed parties 8 to 11 have been served privately. Though notice is sent to them through Court, have been returned for want of sufficient address. Considering the facts that this application is to implead them as respondents in Testamentary original suit, private service is deemed sufficient.

3. In view of the above, this application is allowed. The respondents 2 to 11 are brought on record in the main Testamentary Original Suit namely T.O.S.No.28 of 2007.

4. The counsel for the plaintiff to serve the papers on the counsel appears for respondents 2 to 7 and also take steps for service of notice through Court as well as privately on the respondents 7 to 11 in the Testamentary Original suit, for the hearing on 19.08.2019. Batta to be paid by 25.07.2019.
