ORDER
This writ petition has been filed for issue of writ of mandamus directing the 4 th respondent to consider the application submitted by the petitioner on 05.02.2024 and to grant patta in her name after subdividing the lands within the time frame fixed by this Court.
2.Heard Mr.N.R.Gopalan, learned counsel appearing on behalf of the petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing on behalf of the respondents..
3/6 3.The petitioner is heavily relying upon the suit that was filed in O.S.No.156 of 2004 as against respondents 2 to 4 where the suit was decreed in favour of the petitioner by judgment and decree dated 03.08.2010. The further grievance of the petitioner is that the respondents 2 to 4 filed an appeal in A.S.No.82 of 2015 and the same was also dismissed on 15.06.2023. In spite of the same, the 4 th respondent is not acting upon the representation made by the petitioner and granting the patta in her favour after subdividing the property. It is under these circumstances, the present writ petition has been filed before this Court seeking for appropriate directions.
4.Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 4 th respondent to act upon the application submitted by the petitioner on 05.02.2024 by placing reliance upon by the Civil Court Decree that stands in favour of the petitioner and pass appropriate orders, within a period of four weeks from the date of receipt of copy of this order.
