The instant writ petition has been filed with a prayer for issuing a Mandamus to direct the respondents to dispose the petitioner's representation dated 21.12.2024.

The learned counsel for the petitioner would submit that the fifth respondent is the wife of the petitioner, and he is working in the Tamil Nadu Electricity Board and had submitted an application for voluntary retirement. He would further submit that the fifth respondent was not properly maintained by the petitioner. He also submits that in order to effectively maintain the family, the income is very much essential. Therefore, before considering the application of the petitioner's husband's voluntary retirement, she also needs to be consulted.

3. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the first to fourth respondents and perused the materials available on record.
4. It is pertinent to mention here that the fifth respondent, being major, has been working in the Tamil Nadu Electricity Board as a regular employee. He is competent enough to take a decision either to continue or retire. Though the petitioner is entitled for maintenance in accordance with law, since because of the maintenance issue between both of them, she may not have any better right than the fifth respondent to object for voluntary retirement. It is further relevant to refer that in the personal dispute of the petitioner and the fifth respondent, the other official respondents cannot be made a party by filing this Writ Petition. In such view of the matter, this Court does not find any merits in this Writ Petition.
