Respondents PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of mandamus directing the respondents to consider the petitioner's representation dated 13.10.2017 and remove the encroachment made on the pathway of burial ground in S.F.Nos.35/3 and 35/4 in Sennagiri Village, Salem South Circle, Salem District, expeditiously in accordance with law.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This writ petition has been filed seeking orders on the respondents to remove the encroachments on the pathway to the burial ground in Survey Nos.35/3 and 35/4 at Sennagiri Village in Salem District.

2. There can be no doubt that pathways to a burial ground should be kept free from encroachment as prayed for by the writ petitioner.

3. The learned Government Pleader (in-charge) submits that the representation of the petitioner has been made over to the Revenue Divisional Officer for necessary action.

4. The respondents shall ensure that encroachments, if any, are removed in accordance with law forthwith, preferably within two months from the date of communication of this order.
