ORDER

The petitioner has come up with the present writ petition for a mandamus, directing the first respondent to grant the Chief Minister's Relief Fund by considering her representation dated 15.02.2016.

2. The case of the petitioner is that her husband Masilamani was a contract labourer in Technical Centre of Ashok Leyland Company at Velli Voyal Chavadi. In the course of such work, while her husband was doing painting work at 10.30am on 10.01.2016 in a crane, he fell down and died, due to lack of security provided by the company. lodged and the same was registered as FIR in Crime No.14/2016 dated 10.01.2016 under Section 174 Cr.P.C by the second respondent police. The petitioner is having one son and two daughters and she finds it difficult to eke out her livelihood, due to the death of her husband. Hence, she made a representation dated 15.02.2016 to the first respondent requesting to grant compensation under the Chief Minister's Relief Fund. However, till date, no order has been passed by the first respondent. Therefore, the petitioner has filed the present writ petition for the above stated relief.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader, who took notice for the respondents.

Considering the limited nature of the relief sought for herein, this Court directs the first respondent to consider the representation of the petitioner dated 15.02.2016, by affording an opportunity of personal hearing to the petitioner as well as to all the necessary parties, if any and pass appropriate orders. It is made clear that this Court is not expressing any opinion with regard to the merits of the claim made by the petitioner and it is for the first respondent to pass appropriate orders purely on merits and in accordance with law. The entire exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.

5. The writ petition is disposed of accordingly. No costs.
