ORDER

This Criminal Original Petition has been filed seeking a direction to the respondent to register the complaint dated 15.06.2016.

Heard the learned counsel appearing for the petitioner and the learned Additional public prosecutor appearing for the respondent.

It is seen that this petitioner has lodged a complaint against his son contending that his son is not taking care of her and he is not paying the amounts which is received as rent from the property. In this regard, this petitioner lodged a complaint dated 05.02.2016 and filed Crl.OP.No.5342 of 2016, in which, this Court passed a direction on 10.03.2016. Following the order passed by this Court, the respondent conducted an enquiry and closed the same on 11.03.2016. https://hcservices.ecourts.gov.in/hcservices/

It is the case of the petitioner that during the enquiry, her son paid certain amounts to the petitioner to the tune of Rs.12,000/- per month up to date on 10.03.2016 and thereafter, he has not paid and therefore, this petitioner has given a second complaint dated 15.06.2016 and has filed the present petition for a similar direction.

5. In the considered opinion of this Court, the respondent cannot register an FIR on the complaint given by the petitioner. In a case of this nature, it is open to the petitioner to approach the appropriate authority under Senior Citizen Act and get orders.

In view of the above, the criminal original petition is closed.
