Today the matter is listed for counter and disposal. However, the respondent has not filed the counter. Therefore, heard the learned counsel for the applicant and passes the following orders:

2. This application has been filed to substitute the name of the applicant as M.Ponnaiyah Nageshwaran as Managing Trustee of the plaintiff Trust in the suit in CS.No.261 of 2020 instead of P.Murugesan.

3. The learned counsel for the applicant has produced a copy of a document viz., the amendment to the prist Trust dated 24.06.2021 registered as Doc.No.52 of 2021 on the file of the SRO, Thanjavur along with this application which reveals that M.Ponnaiyah Nageshwaran has become the Managing Trustee of the plaintiff Trust, after the demise of P.Murugesan.

3. The reason stated in the accompanying affidavit is satisfied and hence, this application is allowed.

4. The applicant is directed to carry out the necessary amendment

and file the amended copy of the suit in CS.No.261 of 2021.

5. List the matter on 19.04.2022.
