ORDER

This writ petition has been filed seeking a direction to the 1st, 2nd and 4th respondents to record the death of Suresh Natarajan Bharadwaj on 21.06.2019 in the birth and death register of corporation of Chennai and issue death certificate of Suresh Natarajan Bharadwaj to the petitioner.

2. It is the case of the petitioner that his mother died on 30.07.2009 and his father died on 25.02.2016. The petitioner's brother viz., Suresh Natarajan Bharadwaj was missing from his residence on 21.06.2019 and FIR registered under man missing case in Cr.No.196 of 2019 on the file of the third respondent. One A.M.Sundaram, who is father in law of the petitioner has filed HCP.No.1382 of 2019 before this Court and this Court directed the 3rd respondent to file a status report. Accordingly, the 3rd respondent filed a status report said that some persons murdered the above said Suresh and therefore, the HCP is closed. Further the above said Sundaram filed a writ petition before this Court seeking a direction directing the first and second respondent to record the death of Suresh Natarajan Bharadwaj on 21.06.

2019 in the Birth and Death Register of Corporation of chennai and issue a death certificate. This Court vide order dated 05.09.2019, disposed of the writ petition with liberty to the petitioner herein to make request to the first respondent-Corporation after final report is filed by the third respondent.

the investigation and filed final report and the same is taken on file in SC.No.58 of 2019 before the learned Additional City Civil Court, Chennai stating that the deceased was murdered and thrown in sea. The 3rd respondent had taken serious efforts to trace the body. But the 3rd respondent is not able to find the body of the deceased. Hence, the petitioner made a representation on 06.03.2023 before the first respondent and on 27.03.2023 before the second respondent to record the death of his brother Suresh Natarajan and issue death certificate of the deceased. But the said representation is kept pending. Hence, the present writ petition.

The learned Government Advocate submitted that after completion of elaborate and detailed investigation, the Inspector of Police have filed a charge sheet before the learned Additional City Civil Court, Chennai stating that the deceased was murdered and his body was thrown in sea. The 3rd respondent had taken serious efforts to trace the body. But the 3rd respondent is not able to find out the body of the deceased.

Recording the said submission made by the learned Government Advocate, this Court directs the second respondent to register the death of the petitioner's brother viz., Suresh Natarajan Bharadwaj in terms of the final report filed by the third respondent and also the order passed by this Court in

WP.No.26554 of 2019 dated 05.09.2019 within a period of six weeks from the date of receipt of a copy of this order, if there is no legal impediment.
