ORDER

This contempt petition is filed to punish the respondent for having disobeying the order passed in Crl.O.P.No.17435 of 2012 dated 13.08.2012.

2.It is submitted by the learned counsel for the petitioners that it was represented by the learned Additional Public Prosecutor in Crl.O.P.No.17435 of 2012 that the petitioners would be arrayed as witness in the case registered in crime no.2 of 2010, but no statement was obtained from the petitioners and the petitioners were not cited as witness and therefore contempt has been committed. 3.I am unable to accept the contention of the learned counsel for the petitioners. Admittedly, the petitioners are not able to state whether any charge sheet has been filed in crime no.2 of 2010. Only at the time of filing of charge sheet, list of witnesses will be made known and it is submitted by the learned Additional Public Prosecutor that only at the time of filing of charge sheet, witnesses name will be known.
