Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus, to direct the 1st respondent / The Additional Chief Secretary / Commissioner of Revenue Administration, Department of Revenue and Disaster Management to place the petitioner above the name of M.Selvam in the list of 'Assistant' of the year 2006 based on the proposal made in COLREV-COLR/10798/2023-A2 on the file of the District Collector, Thiruvallur dated 19.04.2023 and further direct the respondents to fix pay scale as Assistant from the year 2006 and provide one incentive increment.

This Writ Petition has been filed in the nature of a Mandamus, seeking a direction against the respondents to examine the proposal of the District Collector, Thiruvallur dated 19.04.2023. 2.The petitioner was working as a Junior Assistant. At that time, a criminal case has been registered against him for demand and acceptance of bribe amount.

3.The learned counsel for the petitioner states that the petitioner was acquitted of all charges during the criminal trial. Subsequently, departmental proceedings were initiated and it is contended that the charges have been dropped. The petitioner now claims that he should be promoted from Junior Assistant to Assistant and be paid all the requisite allowances and monetary benefits. He further claims that a proposal in this regard was forwarded by the District Collector on 19.04.2023 4.A direction is issued to the respondents to examine the Service Register of the petitioner and determine whether the petitioner is entitled to be promoted to the post of Assistant and take a decision within a period of three months from the date of receipt of a copy of this order. 5.The Writ Petition stands disposed of.
