Nipun Navnitbhai Mehta v. Guna David
C.M.P.No.5812 of 2026 in C.R.P.SR.No.14427 of 2026 P.B.BALAJI, J.
This petition has been filed to grant leave to file the revision petition challenging the compromise decree dated 16.11.2024 passed in OS.No.650 of 2024 III Additional District and Sessions Judge, Salem.
2. The petitioner is a third party in O.S.No.650 of 2024 before the III Additional District and Sessions Judge, Salem. According to the learned counsel for the petitioner, the petitioner without being arrayed as party in the said suit, the parties therein have agreed upon a compromise and have brought about a collusive compromise decree on 16.11.2024 which directly affect the rights of the petitioner. The petitioner has therefore challenged the said award based on the compromise decree by invoking Article 226 of the Constitution of India.
3. Having satisfied myself with the reasons assigned in the affidavit filed in support of this leave petition, the application for leave is ordered.
