ORDER
The petitioner apprehends arrest for the alleged offence under Sections 296(6), 351(3), 303(2) and 62 of the BNS Act, 2023, in Crime No.20 of 2026 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that on 26.01.2026, the de facto complainant found that the petitioner, along with other accused, attempting to break into her house and commit theft. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has five previous cases, all registered under the Juvenile Justice Act when the petitioner was a minor. Hence, he prayed for grant of bail to the petitioner.
3. The learned Government Advocate (Crl. Side) for the respondent police opposed the grant of anticipatory bail stating that the petitioner has five previous cases.
4. In such view of the position, even after attaining majority, the petitioner appears to have not mended himself to live peacefully. It is amply clear that the petitioner has misused the liberty already granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
